Terms of Service

These terms apply to richkapp.com, booking.richkapp.com, BreakThrough advisory sessions, and website creation work arranged through RichKapp.

Who these terms are with
RichKapp is the personal site and service surface for Richard Kappel. In these terms, "I", "me", and "Richard" refer to Richard Kappel. "You" means the person or business using the site, booking a session, or hiring Richard for advisory or website work.

What RichKapp provides
- BreakThrough advisory work for builders, founders, solopreneurs, operators, and small teams.
- Booking and scheduling for conversations with Richard.
- Website creation work when agreed in writing.
- Related strategy, brand, operations, software, workflow, and AI thinking when it supports the work.
BreakThrough is not therapy, medical advice, legal advice, financial advice, or a replacement for professional advice in regulated areas.

Booking and advisory sessions
A first conversation may be offered free. Ongoing BreakThrough work is arranged through the current offer structure or another written agreement.
Clients are responsible for showing up on time, bringing honest context, and making their own decisions after the conversation. Richard can listen, challenge, brainstorm, research, advise, and help turn pressure into next steps, but final decisions and outcomes remain the client's responsibility.
If a client needs to cancel or reschedule, they should use the booking link or contact Richard as early as possible.

Website creation work
Website creation work starts only after scope, price, timeline, deliverables, and payment terms are agreed in writing.
- The client is responsible for supplying accurate business information, copy, images, approvals, and any required legal or compliance text.
- Richard may advise on copy, structure, positioning, design, and implementation, but the client is responsible for approving final public content.
- The client is responsible for domain registration, hosting subscriptions, third-party accounts, business licenses, privacy requirements, cookie requirements, and industry specific compliance unless Richard explicitly agrees to manage a piece of that work.
- Website delivery may depend on timely client feedback, access, assets, and approvals.
- Revisions outside the agreed scope may require additional paid work.

Payments
Payment terms are agreed before paid work begins. Some work may require a deposit, staged payments, or full payment before delivery. If payment is late, work may pause until the account is current.
Stripe or another agreed payment provider may process payments. RichKapp does not store full payment card details.

Client content and approvals
Clients confirm that they have the right to use any text, images, logos, brand materials, testimonials, business data, or other content they provide.
Clients are responsible for reviewing and approving final copy, claims, prices, offers, policies, legal text, and public information before launch. Richard does not guarantee that client supplied content is legally compliant, non-infringing, complete, or suitable for every jurisdiction.

Ownership
Unless a written agreement says otherwise:
- Clients own the final custom website content and design work created specifically for them after full payment.
- Richard keeps ownership of reusable methods, templates, components, workflows, know-how, internal tools, and general ideas not unique to the client.
- Third-party tools, fonts, libraries, themes, plugins, platforms, and services remain governed by their own licenses.

Confidentiality
BreakThrough advisory and website creation can involve sensitive business or personal context. Richard will not intentionally publish private client information, session details, unfinished ideas, or confidential project material without permission.
This does not prevent Richard from using general experience, non-confidential learnings, reusable patterns, or anonymized knowledge in future work.

No guaranteed outcome
Richard will use care and judgment, but no specific result is guaranteed. Advisory work, strategy, websites, positioning, and business decisions depend on many factors outside RichKapp's control.

Acceptable use
You agree not to use the site, booking system, contact form, or project communication channels to spam, harass, abuse, send malware, attempt unauthorized access, submit false information, or interfere with the service.

Limitation of liability
To the maximum extent permitted by law, RichKapp is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, lost opportunities, or business interruption.
For paid work, total liability for a claim is limited to the amount paid for the specific work that gave rise to the claim, unless applicable law requires otherwise.

Changes and termination
RichKapp may update these terms as the site and services evolve. The updated date will reflect material changes.
Richard may decline, pause, or end work when there is non-payment, abuse, lack of fit, scope conflict, legal risk, or behavior that makes the work unworkable.
