Who these terms are with

kapp is the personal site and service surface for Richard Kappel. In these terms, "I", "me", and "Richard" refer to Richard Kappel. "You" means the person or business using the site, booking a session, or hiring Richard for advisory, website, or Custom AI Agent Build work.

What kapp provides

• BreakThrough advisory work for builders, founders, solopreneurs, operators, and small teams.
• Booking and scheduling for conversations with Richard.
• Website creation work when agreed in writing.
• Custom AI Agent Build work for advisors, coaches, and consultants when agreed in writing.
• Related strategy, brand, operations, software, workflow, and AI thinking when it supports the work.

BreakThrough is not therapy, medical advice, legal advice, financial advice, or a replacement for professional advice in regulated areas.

Booking and advisory sessions

A first conversation may be offered free. Ongoing BreakThrough work is arranged through the current offer structure or another written agreement.

Clients are responsible for showing up on time, bringing honest context, and making their own decisions after the conversation. Richard can listen, challenge, brainstorm, research, advise, and help turn pressure into next steps, but final decisions and outcomes remain the client's responsibility.

If a client needs to cancel or reschedule, they should use the booking link or contact Richard as early as possible.

Website creation work

Website creation work starts only after scope, price, timeline, deliverables, and payment terms are agreed in writing.

• The client is responsible for supplying accurate business information, copy, images, approvals, and any required legal or compliance text.
• Richard may advise on copy, structure, positioning, design, and implementation, but the client is responsible for approving final public content.
• The client is responsible for domain registration, hosting subscriptions, third-party accounts, business licenses, privacy requirements, cookie requirements, and industry specific compliance unless Richard explicitly agrees to manage a piece of that work.
• Website delivery may depend on timely client feedback, access, assets, and approvals.
• Revisions outside the agreed scope may require additional paid work.

Custom AI Agent Build work

Custom AI Agent Build work starts only after scope, price, the target workflow, deliverables, ownership, and payment terms are agreed in writing.

Unless a written agreement says otherwise:

• The engagement covers one agreed workflow and one custom agent or agent system built for that workflow.
• The client is responsible for providing timely access, examples, knowledge sources, tools, accounts, and feedback needed to diagnose, build, test, and hand over the agent.
• The client is responsible for approving the final workflow, boundaries, refusals, human handoffs, and acceptance criteria before the agent is treated as complete.
• Third-party model, platform, hosting, integration, API, and software charges remain the client's responsibility unless Richard explicitly includes them in writing.
• Revisions outside the agreed scope may require additional paid work.

5-hour guarantee

For Custom AI Agent Build work sold with the public 5-hour guarantee:

• Before the build begins, Richard and the client agree in writing on the workflow and a reasonable weekly time baseline for completing it without the finished agent.
• The client then uses the finished agent in that agreed workflow for 14 consecutive days under normal working conditions.
• Time saved is the difference between the agreed baseline and the time the client still spends completing that workflow with the finished agent, averaged per week across the 14-day period.
• If the measured saving is less than five hours per week, the client may request a refund within 14 days after the measurement period ends. Richard will refund 100% of the build fee paid to him for that Custom AI Agent Build.
• The guarantee applies only to Richard's build fee. It does not cover third-party model, platform, hosting, integration, API, software, advertising, or other external charges.
• The client must complete the initial week review, provide the agreed access and examples, use the finished agent as handed over, and provide enough information to verify the time-saving result.
• The guarantee does not apply when non-use, a material change to the agreed workflow, withheld access, a third-party outage, or use outside the agreed boundaries prevents the agent from being used or measured as agreed.
• The guarantee is a time-saving promise for the agreed workflow. It is not a guarantee of revenue, leads, sales, or any other business outcome.

Payments

Payment terms are agreed before paid work begins. Some work may require a deposit, staged payments, or full payment before delivery. If payment is late, work may pause until the account is current.

Stripe or another agreed payment provider may process payments. kapp does not store full payment card details.

Client content and approvals

Clients confirm that they have the right to use any text, images, logos, brand materials, testimonials, business data, or other content they provide.

Clients are responsible for reviewing and approving final copy, claims, prices, offers, policies, legal text, and public information before launch. Richard does not guarantee that client supplied content is legally compliant, non-infringing, complete, or suitable for every jurisdiction.

Ownership

Unless a written agreement says otherwise:

• Clients own the final custom website content, design work, and custom agent work created specifically for them after full payment, subject to any written ownership terms for that project.
• Richard keeps ownership of reusable methods, templates, components, workflows, know-how, internal tools, and general ideas not unique to the client.
• Third-party tools, fonts, libraries, themes, plugins, platforms, and services remain governed by their own licenses.

Confidentiality

BreakThrough advisory, website creation, and Custom AI Agent Build work can involve sensitive business or personal context. Richard will not intentionally publish private client information, session details, unfinished ideas, or confidential project material without permission.

This does not prevent Richard from using general experience, non-confidential learnings, reusable patterns, or anonymized knowledge in future work.

No guaranteed outcome

Richard will use care and judgment. Except for the Custom AI Agent Build 5-hour guarantee above, no specific business, revenue, lead, or life outcome is guaranteed. Advisory work, strategy, websites, positioning, software, AI systems, and business decisions depend on many factors outside kapp's control.

Acceptable use

You agree not to use the site, booking system, contact form, or project communication channels to spam, harass, abuse, send malware, attempt unauthorized access, submit false information, or interfere with the service.

Limitation of liability

To the maximum extent permitted by law, kapp is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, lost opportunities, or business interruption.

For paid work, total liability for a claim is limited to the amount paid for the specific work that gave rise to the claim, unless applicable law requires otherwise.

Changes and termination

kapp may update these terms as the site and services evolve. The updated date will reflect material changes.

Richard may decline, pause, or end work when there is non-payment, abuse, lack of fit, scope conflict, legal risk, or behavior that makes the work unworkable.
