Terms of Service

By creating an account on richkapp.com or purchasing any product (including MyKit), you agree to these terms. Please read them carefully. The short version: the Learn platform is educational content. Any software you deploy is your responsibility.

Definitions

  • "The Platform" refers to richkapp.com, including the Learn modules, dashboard, and any associated services.
  • "Educational Content" refers to all lessons, tutorials, guides, and instructional material provided through the Learn platform.
  • "Software" refers to source code provided as part of a purchase (e.g., MyKit), including any forks, modifications, or derivatives you create.
  • "You" / "Buyer" refers to anyone who creates an account or makes a purchase on the Platform.
  • "We" / "Richard Kappel" refers to the operator of richkapp.com.

Nature of the product

The Learn platform and all associated modules (including MyKit) are educational products. The lessons teach software development concepts through guided, hands-on building exercises.

Important:

The source code provided with MyKit and other paid modules is delivered as part of the educational experience. It is intended to help you learn how software is built and to give you a starting point for your own projects. It is not a managed service, hosted product, or turnkey business solution.

Ownership and license

When you purchase MyKit or any paid module:

  • You receive a perpetual, non-exclusive license to use, modify, and deploy the source code for your own business or personal use.
  • You may not resell, redistribute, sublicense, or share the source code or educational content with third parties.
  • You may deploy the software for your own business operations (e.g., managing your own customers, jobs, and invoices).
  • You may not offer the software as a service (SaaS) to third parties, or use it to create a competing educational product.

Your responsibilities

Once you deploy the software to your own infrastructure, you are fully responsible for:

  • Server provisioning, configuration, maintenance, and security
  • Database backups, updates, and disaster recovery
  • Keeping dependencies, packages, and the operating system up to date
  • Securing API keys, credentials, and environment variables
  • Compliance with applicable laws and regulations (including GDPR, PCI-DSS, data protection, and privacy laws in your jurisdiction)
  • Protecting your customers' data
  • Any modifications you make to the source code

The lessons include guidance on security best practices (firewall setup, rate limiting, least-privilege database access, etc.), but following these lessons does not guarantee security. You are responsible for assessing and maintaining the security posture of your deployment.

No warranty

THE SOFTWARE AND EDUCATIONAL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

Limitation of liability

To the maximum extent permitted by applicable law:

  • Richard Kappel is not liable for any data breaches, data loss, security incidents, downtime, or business losses arising from your deployment or use of the software.
  • Richard Kappel is not liable for any damages resulting from your failure to maintain, update, or secure your deployment.
  • Total liability for any claim related to the Platform or any purchase shall not exceed the amount you paid for the product.

Support and updates

Your purchase is a one-time transaction for educational content and source code access. There is no ongoing support obligation, service-level agreement, or guaranteed update schedule. We may update lessons or source code at our discretion, but are not required to do so. If you need hands-on help with your deployment, custom development services are available separately via the contact page.

Account and payments

  • You are responsible for maintaining the security of your account credentials.
  • Payments are processed securely through Stripe. We do not store your payment card details.
  • All purchases are final. Due to the immediate delivery of digital content and source code access, refunds are not available after purchase. If you experience a technical issue preventing access to content you've paid for, contact us and we'll resolve it.

Free modules

Some modules are offered for free. These are subject to the same terms regarding educational nature, no warranty, and limitation of liability. Free modules may be modified or removed at any time.

Termination

We reserve the right to suspend or terminate accounts that violate these terms, including but not limited to redistribution of source code or educational content. If your account is terminated for a violation, no refund will be issued. Source code you have already downloaded and deployed remains yours under the license terms above.

Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the Platform after changes are posted constitutes acceptance of the updated terms. For material changes, we will make reasonable efforts to notify affected users.
